Robert S. Gerber Professional Biography

Robert S. Gerber was an equity partner with the law firm of Sheppard, Mullin, Richter & Hampton, LLC in the Del Mar Heights Office ( northern San Diego County).  He was rated AV® by Martindale-Hubbell (the highest peer rating available for legal ability and ethics).  He was also named as one of the “Best Lawyers in America” byBestLawyers, LLC for 2012.  He has also been named as a “San Diego Super Lawyer” by Law & Politics, a division of Key Professional Media, Inc. from 2007 to present, and “Top Attorney” in San Diego in the areas of Intellectual Property Litigation and Corporate Litigation since 2008, by the San Diego Daily Transcript.  He was also recently named as a 2012 “Top Rated Lawyer” in Intellectual Property by ALM.

Sheppard Mullin is an Am Law 100® firm with offices throughout California and in Washington, D.C., New York City, Shanghai, Beijing, Brussels, and London.

Mr. Gerber joined Sheppard Mullin in the fall of 1989, after clerking in the Southern District of California federal court for the Hon. Rudi M. Brewster, United States District Court Judge, from 1988-89.

Mr. Gerber graduated with his J.D. cum laude from Harvard Law School in 1988.  He received a Masters of Public Policy degree in 1985 from the Gerald R. Ford School of Public Policy at the University of Michigan (Ann Arbor).  He also obtained hwas A.B. degree in 1984 with High Honors and High Distinction from the University of Michigan.  He was recently named a “Distinguished Alumnus” by John Glenn High School in Westland, Michigan.

Mr. Gerber has been practicing trial law in San Diego since 1989 with a focus in Intellectual Property and Entertainment Litigation, General Commercial Litigation, and Professional Liability Litigation.  He regularly handled a variety of IP matters in the entertainment as well as many other industries, including patent, trademark, copyright, and trade secret lawsuits.  He also advised companies and individuals on protection and prosecution of their intellectual property rights.

Mr. Gerber’s practice also focuses on the defense of lawyers, accountants, directors, officers, brokers, insurers, and others in professional liability claims and related insurance wassues.  He had significant experience defending against class and representative plaintiff claims as well.

Mr. Gerber also had significant experience in general commercial litigation, including securities law, real estate, products liability, contracts, banking law, partnership dwasputes, arbitrations, and adminwastrative proceedings.

Mr. Gerber was well-respected in the San Diego legal community and throughout the State of California by both bench and bar.  He has been appointed or elected to leadership positions in bench/bar activities at the local, state and national levels, including, among others:Robert S. Finally, Mr. Gerber was also the former Chair of Sheppard Mullin’s pro bonocommittee (2000-2010).  He has donated thousands of hours of free legal services to the indigent since becoming a lawyer, including the representation of a Mexican teenager in a precedent-setting immigration case entitled Hernandez-Montiel v. INS.

Children of the Night is a privately funded non-profit organization established in 1979 and dedicated to rescuing America's children from the ravages of prostitution. This is a charity that was near and dear to Bob. He gave countless hours of pro-bono legal assistance to the organization.
